INJURY
1. When a person or entity is injured by the negligence or wrongful
acts of another, the injured party should be entitled to receive fair
dispensation.
2. Historically, I have participated in many personal injury cases
that include damage calculations prepared by other “experts”
that do not consider very important issues. Frequently, counsel will
provide an economist with a very limited grouping of documents. The
economist, in turn, will apply the limited assumption base to their
software programs and spit out a report that may not reflect all important
issues to be considered. In other cases, the opposing party’s
expert may make claims for all kinds of economic damages and fail
to consider mitigating events and circumstances that need to be applied.
3. Dirk has done cases that have claimed more than a million dollars
in special damages that have been reduced to zero damages with his
report and testimony. These cases do not happen that often, but do
illustrate the need for the defense to seriously look at the damages
issues and claims of the plaintiff.
4. When Plaintiff’s support is necessary, Dirk will require
that all known documents be available. In cases where there is construction
or property damage and defects, Dirk has an excellent grasp on how
things are made and constructed. When Lost Wages and Lost Profits
are the main issues of a personal injury case, Dirk can provide an
expert report based on well researched information. No matter what
