MEDIATION

1. Dirk von Guenthner has been trained by the American Arbitration Association in Mediation.

2. Dirk has participated in many mediations as a mediator and on behalf of a party.

3. Although mediation is certainly the least expensive method of dispute resolution, it is often attempted at a time when there is not enough information available (or at least known) to educate and convince your client and the other party to resolve the issue.

4. Further, the timing of a Mediation is extremely important if there are any adverse issues with the individual parties that my not allow them to be objective to settle when the terms of settlement are otherwise equitable.

5. If parties agree to have Dirk von Guenthner participate in the role of the mediator, they (or their counsel) should discuss the merits of his experience before contact is made.

6. If you or your client have a dispute that you wish to resolve and mediation is an option or is required, we recommend that you contact us early on in order to evaluate the issues of your case and to prepare the requisite supporting analysis necessary to attest and prove issues needing identification before the mediation process begins.

7. Often, counsel has benefitted by having Dirk participate in the entire mediation event. Having someone there to remind them of issues needing further discussion or the consideration of new and unique concepts brought up by Dirk during the mediation can be invaluable. Further, Dirk can explain the merits of financial issues to your client in order that mediation can be successful.
